The terms for using our website and our lead-response software, including connecting platforms such as Thumbtack.

These Terms of Service ("Terms") are an agreement between you and Nova Heritage Group LLC, a Missouri limited liability company ("Nova Heritage Group," "we," "us"). They apply when you use our website, novaheritagegroupllc.com, or use or authorize our lead-response software (the "Service"). If you use the Service for a business, you agree to these Terms on behalf of that business and confirm you have authority to do so.
Our accounting, bookkeeping, payroll, tax and custom software services are provided under a separate written agreement or engagement letter. If that agreement conflicts with these Terms, the signed agreement controls.
The Service helps small businesses respond to customer leads, share estimate ranges based on the business's own pricing rules, follow up, and schedule jobs. It can connect to platforms the business authorizes, such as Thumbtack, Google Calendar, a phone number and website forms.
Messages are sent on behalf of your business, which is the sender. The Service messages people who contacted your business first, honors STOP and other opt-out requests immediately, and avoids sending messages late at night or early in the morning. The Service identifies itself as your business and answers honestly if a customer asks whether they are speaking with an automated assistant.
The Service uses artificial intelligence, which can make mistakes. Estimates are ranges based on your pricing rules, and the Service is designed to send unusual requests to you for approval. You are responsible for reviewing and approving content according to the settings you choose.
Your business data and your customers' information belong to you. We use it only to provide the Service, as described in our Privacy Policy. The software, design and automations that make up the Service belong to Nova Heritage Group.
Fees for the Service are set out in your signed agreement with us. Using the website and connecting a platform for evaluation does not create any charge unless agreed in writing.
Except as expressly stated in a signed agreement, the website and Service are provided "as is" and "as available." Nova Heritage Group makes no other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose or uninterrupted, error-free operation. We do not guarantee any number of leads, bookings or revenue. Information on our website is general and is not legal, tax or financial advice for your situation.
To the extent permitted by law, neither party is liable for indirect or consequential losses, including lost profits, lost jobs or lost leads, and Nova Heritage Group's total liability relating to the website or Service is limited to the fees you paid us for the Service in the three months before the claim. These limits do not apply to liability for gross negligence or willful misconduct, or where your signed agreement says otherwise.
You will defend and hold harmless Nova Heritage Group LLC and its members from claims arising from your services, jobs, pricing, customer disputes, instructions or approvals, or your violation of any law or platform terms.
You may stop using the Service and revoke platform access at any time, subject to any notice period in your signed agreement. We may suspend or end access if the Service is used unlawfully or in violation of these Terms.
These Terms are governed by the laws of the State of Missouri. Any dispute that can't be resolved through good-faith discussion will be handled in the state or federal courts serving Jackson County, Missouri.
We may update these Terms from time to time. The effective date at the top shows when they last changed. Continuing to use the Service after a change means you accept the updated Terms.
